Agreement to Arbitrate: By agreeing to these Terms of Use, you agree that any disputes, claims, or controversies arising out of or relating to this Agreement or your relationship with Mission Loans, its parents, subsidiaries, or affiliates (collectively “Company”), will be submitted to confidential, final, and binding arbitration with the American Arbitration Association (“AAA”). The arbitration will be conducted by a single arbitrator in accordance with the terms of this Arbitration Agreement, and all disputes will be resolved on an individual basis, waiving any right to participate in a class action. The Federal Arbitration Act governs the interpretation and enforcement of this Arbitration Agreement.

Prohibition of Class and Representative Actions and Non-Individualized Relief: You and Mission Loans agree that claims against each other may only be brought on an individual basis and not as a plaintiff or class member in any purported class or representative action. Unless both parties agree otherwise, the arbitrator may not consolidate or join more than one person’s claims or preside over any form of consolidated, representative, or class proceeding.

Arbitration Procedures: Arbitration will be conducted in accordance with AAA Streamlined Rules and will adhere to AAA Consumer Minimum Standards, including cost allocation. The arbitrator will have exclusive authority to resolve any disputes regarding the interpretation, applicability, or enforceability of these terms. Any arbitration shall be governed by the Federal Arbitration Act. However, you may choose to bring a claim in small claims court if it meets the requirements.

Governing Law: These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any legal actions must be filed in the state or federal courts located in California.
